Q. When advertising "free hearing test," must I include a qualification as to the nature of the hearing test?
A. Yes, advertisements that include the phrase "free hearing test" must include qualification as to the purpose of the test. The qualification could be "Test to determine if you could be helped by a hearing aid", "Test to determine the need for amplification", or a similar phrase. The qualification should be in a print large enough to be read by all.
Q. When advertising 50% off a specific hearing aid must I include the regular and discounted price?
A. Yes. Business and Professions Code Section 651 requires price advertising to be specific. Therefore, the make and model of the hearing aid and the regular and discounted price must be included.
Q. May an advertisement include "50% Off - All Digital Hearing Aids"?
A. Yes, but the ad must include what the discount is off of, such as, MSRP, List Price (list price must be available to the public), etc. and must include the time frame the offer is available (Offer good July 7-14, 2010).
Q. Can I include the term "Audioprosthologist" in my advertisements?
A. Yes, the term "Audioprosthologist" may be included as long as it is used in conjunction with your hearing aid dispenser license number.
Q. Can I advertise my certifications from professional organizations?
A. Yes, but they must be written in a manner that is easily understood by consumers and include the certifying organization. (Examples: NB-HIS, Certified by the National Board of Certification in Hearing Instrument Specialist; ACA, Certified by the American Conference of Audioprosthology.
