DCA Wins Interim Suspension Order Against Murrieta Funeral Home

SACRAMENTO — An administrative law judge today granted a request by the Department of Consumer Affairs (DCA) to temporarily close Valley Funeral Home in Murrieta, pending a decision on whether to revoke the mortuary's license permanently.

"We feel it is in the best interest of consumers that Valley Funeral Home not be allowed to do any business while our case against it continues," said DCA Director Charlene Zettel.

Following an investigation by its Cemetery and Funeral Bureau, DCA filed an Accusation with the Office of Administrative Hearings on Friday, June 9, 2005, alleging unprofessional conduct, gross negligence and incompetence at Valley Funeral Home. The Accusation asks that the mortuary's license and the funeral director's licenses of the owners, John and Lee Ann Wyskiver, be revoked. The interim suspension order covers all three licenses.

A hearing on the Accusation is set for 1:30 p.m., Oct. 3, 2005, at the Office of Administrative Hearings, 1350 Front St., Sixth Floor, in San Diego.

It is unclear whether Valley Funeral Home may have already stopped operating. Efforts by the Bureau to contact the Wyskivers at the site of the mortuary have been unsuccessful.
